General Terms and Conditions (AGB) for Renting Apartments of CASA Volta§ 1 Scope and Contract Partners(1) These General Terms and Conditions apply to agreements concerning the rental of Casa Volta apartments in Nardó/Apulia for accommodation and all other services provided by the owner.(2) Contract partners are the landlord (hereinafter referred to as “renter”) and the guest (hereinafter referred to as “Mieter”).§ 2 Contract conclusion(1) By completing the booking process on the website, the tenant provides a binding offer to complete a rental contract.(2) The contract is only legally concluded by sending a written booking confirmation by e-mail by the landlord.§ 3 Payment Terms(1) A deposit of 20% of the total price will be due upon receipt of the booking confirmation. This is to be paid to the specified account within 7 days.(2) The balance shall be due no later than 4 weeks before arrival without further request.(3) For short-term bookings (less than 29 days before arrival), the total travel price is due immediately.(4) If the tenant fails to pay, the landlord is entitled to terminate the contract and otherwise rent the property; the cancellation fees according to § 5 are calculated in this case.§ 4 Deposit(1) The tenant transfers a deposit of 20% of the total rental amount with the balance.(2) The deposit serves to secure damage to the rental property or the inventory.(3) If no damage is detected, the deposit will be refunded within 7 days of departure to the account specified by the tenant.§ 5 Resignation by the tenant (Stornierung)(1) Resignation from the contract must be made in writing (by e-mail).(2) The following cancellation conditions apply: Up to 30 days before arrival: 50% of the rental price. From the 29th day before arrival or in case of non-arrival: 100% of the rental price (but possibly saved expenses).(3) The conclusion of a travel cancellation insurance is strongly recommended.§ 6 Arrival and departure (Check-in / Check-out)(1) The apartment is available on the day of arrival from 4 pm.(2) On the day of departure, the apartment must be left clean until 11 a.m. The dishes are flushed, the garbage is disposed of and the windows/doors are closed.§ 7 Legal registration obligations and tourist tax (Italian law)(1) Registration obligation (Alloggiati Web): According to the Italian law (Art. 109 TULPS), the landlord is obliged to report the identity of all guests to the local police authority (Questura). The tenant undertakes to provide the landlord with the identification data (identification card or passport) of all passengers before or at the latest upon arrival.(2) Tourist tax (Tassa di Soggiorno): The municipality of Nardó rises a tourist tax. This is not included in the rental price and must be paid in cash on site or (if agreed) separately.§ 8 Non-smokers: A strict smoking ban applies throughout the apartment.(2) Pets: Pets are not allowed.(3) Due care: The tenant has to treat the rental property and the inventory carefully. Damage shall be reported to the landlord immediately.(4) Maximum occupancy: The objects may only be inhabited by the number of persons specified in the contract.§ 9 Liability(1) The landlord is liable for the proper provision of the rental property. Liability for short-term failure of public supply (electricity, water, Internet) is excluded.(2) The landlord is not liable for any of the leased items.§ 10 Final provisions(1) Changes or supplements of this contract require the text form.(2) The German rectification applies. Jurisdiction is Hamburg.(3) If a determination of these Terms and Conditions is ineffective, the effectiveness of the other provisions remains unaffected.
